Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pokal platform, the associated Discord bot, the web dashboard and any related websites, APIs and services (together, the "Service"), operated by the Pokal team ("we", "us", "our"). By using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of these Terms

By creating an account, signing in through Discord, purchasing a plan, or otherwise accessing the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, Refund Policy and Cookie Policy, each of which is incorporated by reference.

2. Definitions

• Seller / Merchant — a user who operates a shop on the Service and offers products for sale.
• Buyer / Customer — a user who purchases a product from a Seller.
• Product — any digital good, license key, role, file, text or other item offered through the Service.
• Plan — a paid or free subscription tier that unlocks features of the dashboard and bot.
• Content — any data, text, images, product listings or other material submitted to the Service.

3. Eligibility & accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a legally binding contract to use the Service. Accounts are created and authenticated through Discord OAuth. You are responsible for all activity that occurs under your account and for keeping your Discord credentials secure. You must provide accurate information and keep it up to date.

4. The service

Pokal provides tools that let Sellers run a storefront on Discord and the web — including product management, stock and license-key handling, automated delivery, embeds, analytics and payment collection. We provide the software and infrastructure; we are not a party to the transaction between a Buyer and a Seller and do not take ownership of any Product. We may add, modify or remove features at any time.

5. Plans, billing & payments

Some features require a paid Plan. Prices are shown on the pricing page and may be billed monthly or yearly. By purchasing a Plan you authorise us (or our payment processors) to charge the applicable fees. Unless stated otherwise, Plans renew automatically for the same period until cancelled. Payments for Plans and Products may be processed through third-party providers (for example card processors or on-chain crypto payments); those transactions are also subject to the provider's own terms.

All fees are stated in the applicable currency and, unless indicated otherwise, are exclusive of any taxes, which are your responsibility. Refund eligibility is described in our Refund Policy.

6. Products & digital delivery

Products offered on the Service are generally digital goods delivered automatically (for example a Discord role, a license key, a text snippet or a download link). Because delivery is immediate and digital, purchases are typically final once delivered. Sellers are solely responsible for the accuracy, legality, quality and delivery of their Products.

7. Acceptable use

You agree not to use the Service to:

• sell or distribute anything illegal, stolen, fraudulent or infringing;
• sell weapons, drugs, counterfeit goods, hacked or stolen accounts, or credentials that violate another platform's terms;
• engage in fraud, money laundering, chargeback abuse or deceptive practices;
• infringe intellectual-property or privacy rights of others;
• distribute malware, spam, or attempt to disrupt, reverse-engineer, overload or gain unauthorised access to the Service;
• violate Discord's Terms of Service, Community Guidelines, or the terms of any payment provider.

We may investigate and take action, including removing Content and suspending accounts, for any suspected violation.

8. Seller obligations

If you operate as a Seller, you are the merchant of record for your sales. You are responsible for describing your Products accurately, honouring your own refund and support commitments to Buyers, complying with all applicable laws (including consumer, tax and export laws), and for any disputes or chargebacks arising from your sales. You grant us a limited licence to host and display your Content solely to operate the Service.

9. Intellectual property

The Service, including its software, design, logos and branding, is owned by us or our licensors and is protected by intellectual-property laws. Except for the rights expressly granted to you, we reserve all rights. You retain ownership of Content you submit but grant us the licence described above.

10. Third-party services

The Service integrates with third parties such as Discord, payment processors and blockchain explorers. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services and do not control their availability.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that any Product sold by a Seller meets your expectations.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or EUR 100.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your Content, your Products, your use of the Service or your violation of these Terms or of any law or third-party right.

14. Suspension & termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms, create risk or possible legal exposure for us, or if we discontinue the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing law

These Terms are governed by the laws of the operator's country of establishment, without regard to conflict-of-law rules. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute, unless mandatory local consumer law provides otherwise.
